1. Introduction
Welcome to Shipwize Services Ltd and Circles Logistics Ltd ("we," "us," "our," or collectively "the Companies").
These Terms and Conditions ("Terms") govern your access to and use of our services — including the websites shipwize.com and circlesja.com, our mobile applications, the customer portals at dashboard.shipwize.com and dashboard.circlesja.com, our logistics tracking and notification systems, and any related digital platforms (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.
These Terms are governed by the laws of Jamaica, including the Electronic Transactions Act 2006, the Consumer Protection Act 2005, and all other applicable local and international regulations.
2. Scope
These Terms apply to all users of our Services, including:
- Registered account holders and guest users
- Individuals, businesses, and agents using Shipwize or Circles platforms
- Any party accessing our Services through a mobile app, web browser, or third-party integration
These Terms do not apply to third-party websites, services, or applications that we do not control, even if linked from our platforms.
3. Definitions
- Account – a unique profile you create to access our Services.
- Affiliate – an entity that controls, is controlled by, or is under common control with either Company.
- Companies / we / us / our – Shipwize Services Ltd and Circles Logistics Ltd, both headquartered in Kingston, Jamaica.
- Content – any text, images, data, or other materials available through our Services.
- Order – a confirmed shipment, delivery, or logistics request placed through the Services.
- Services – all digital and physical logistics services provided by the Companies, including shipping, package handling, delivery, and related offerings.
- Suite Number – the personal identifier we issue you, which forms part of the U.S. shipping address you use when you buy online.
- User / you / your – any individual or entity accessing or using our Services.
4. Eligibility and Account Registration
To access certain features, you must create an Account. By doing so, you confirm that:
- You are at least 16 years of age;
- All registration information you provide is accurate, current, and complete;
- You will keep your account credentials confidential and notify us immediately of any unauthorized use;
- You are legally capable of entering into a binding agreement in your jurisdiction.
Your Account carries a Suite Number that identifies your packages. Anything shipped to that Suite Number is treated as yours, so keep it to yourself and to the senders you intend to use it. You are responsible for what arrives under it.
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
5. Our Services
Shipwize and Circles provide logistics and courier services including but not limited to:
- International and domestic package shipping and forwarding
- Customs brokerage and documentation assistance
- Real-time shipment tracking
- Pickup and last-mile delivery
- Consolidated freight and bulk shipping solutions
Alongside those, we operate the digital platform you use to manage them: these websites, our customer portals and mobile applications, and the systems our staff use to receive, manifest, bill, and release your packages. Access to the digital platform is provided as part of the Services and on the same terms.
The rate estimator — both the one on this website and the one in the customer portal — gives an estimate based on the weight, declared value, and commodity you enter. It is not a quotation and does not bind us. The amount payable is the one on your invoice, calculated when the package is actually weighed, classified, and billed.
Service availability, pricing, and features may vary by location and are subject to change without notice. We will make reasonable efforts to communicate material service changes in advance.
6. Orders, Payments, and Fees
All Orders placed through our Services are subject to the following conditions:
- Pricing: Prices are quoted in Jamaican Dollars (JMD) or US Dollars (USD) as displayed. Taxes and duties may apply.
- Payment: Accepted methods include credit/debit cards, bank transfer, and approved digital wallets. Payment is due at the time of Order confirmation.
- Customs & Duties: The recipient is responsible for all applicable import duties, taxes, and customs fees unless explicitly included in the quoted service fee.
- Refunds: Refunds are subject to our Refund Policy. Contact us within 14 days of an issue for review.
- Disputed Charges: Contact us at info@shipwize.com before initiating a chargeback. We aim to resolve disputes within 10 business days.
7. Store Credit, Rewards Points, and Referrals
Your Account may hold balances that reduce what you pay us. They are account benefits, not money we hold on your behalf.
- Store credit is applied against charges on your account. Every adjustment is recorded with its reason, and the record cannot be edited afterwards.
- Rewards points are earned as packages are paid for — one point per package once its payment completes, counted once per package. Points can be redeemed for store credit at a rate we set and can change; the rate applied is the one in force when you redeem.
- Referral credit is earned when someone signs up with your code and their first package arrives in Jamaica — not when they sign up. Until then the referral is recorded as pending. A referral code cannot be used on your own account, and each referred customer can be claimed only once.
- Promotional offers apply within the dates and conditions stated in the offer. Where more than one benefit could apply to the same charge, we apply the one most favourable to you rather than stacking them, and a charge is never reduced below zero.
These balances are tied to your Account and are not transferable to another account. We apply them against what you owe us rather than paying them out, except where a refund is due under our Refund Policy or the law requires otherwise. Balances arising from error, abuse, or fraud may be reversed. Where we correct a balance we record the correction and the reason for it.
8. Package Status Notifications
We tell you when your packages move. Some of this is automatic; one part of it is optional and needs your consent.
A. Email
Email about your account and your shipments — your welcome email, package status updates, receipts and invoices, password resets, and security codes — is part of the service. Keep a working email address on your Account; we are not responsible for a message you do not receive because the address on the Account is wrong, full, or filtering us.
B. WhatsApp
WhatsApp package notifications are optional and additional. They do not replace email, and turning them off changes nothing else about your Account.
- Consent is double opt-in. Ticking the box on our website, in our mobile application, at sign-up, or at one of our counters does not switch notifications on. It sends you one WhatsApp message asking you to confirm. Notifications begin only when you confirm inside WhatsApp.
- What you get: a message when a package is Received In Miami, Arrives In Jamaica, is Ready for Pickup, or is Delivered to Client, telling you the status, the tracking numbers, and your Suite Number. Packages reaching the same stage together are combined into one message.
- Withdrawal: you can turn it off the same ways you turned it on, or by replying STOP in WhatsApp.
- Your number: you are responsible for giving us a number you control and for keeping it current. If you give us a number that later belongs to someone else, tell us — we cannot know.
- Carrier charges: standard carrier or data charges may apply to you, depending on your mobile plan. They are yours to pay.
C. Delivery is not guaranteed
WhatsApp messages are carried by a third party, Meta Platforms, over networks neither of us controls. We do not guarantee that any notification will be delivered, or delivered on time. Notifications are a convenience. Your Account remains the authoritative record of where your packages are, and you should not rely on a notification arriving before collecting a package, meeting a deadline, or avoiding a charge. We are not liable for a loss caused by a notification that was delayed, duplicated, or never arrived.
Your use of WhatsApp itself is governed by Meta's own terms, which we do not control.

9. Customs Documents and the Forms on This Website
Shipping into Jamaica needs paperwork, and the paperwork has to be true.
- You are responsible for the accuracy and completeness of every declaration you make to us or through us — the description of the goods, their value, and the identity and tax details of the person the shipment belongs to.
- Where you authorize us to act as your agent in clearing goods through the Jamaica Customs Agency, that authorization is limited to the shipments it names and can be withdrawn in writing.
- We may be required to give your declarations and supporting documents to customs authorities and brokers, and we will.
- Verification documents you upload to your Account are held with your customer record and are used for shipment verification and customs compliance.
The forms on this website are filled in and turned into a PDF in your browser, on your own device. What you type into them is not submitted to us by the form; downloading a form does not file it, send it to us, or verify your account. Submit the completed form to us the way the form itself, or a member of our staff, tells you to. The one exception is address suggestions: when you type an address, the text is sent to a third-party address-lookup service so it can offer matches, as described in our Privacy Policy.
Creating an account in the customer portal works the other way round. There, the USPS authorization form and the customs authorization form are filled in from the details you have just entered and are shown to you to check before you go any further. Confirming them is part of creating the account: when you confirm, they are signed with your name, filed to your customer record, and treated as your authorization. Read them before you confirm — what they say is your declaration, and you are responsible for it. You can download your own copies at the same time.
A misdeclaration can lead to delay, seizure, penalties, or prosecution by the authorities, and those consequences fall on you.
10. Prohibited Items and Uses
You agree not to use our Services to ship, handle, or facilitate:
- Illegal substances, controlled drugs, or contraband
- Weapons, firearms, ammunition, or explosives
- Counterfeit, pirated, or intellectual property-infringing goods
- Perishable goods without prior written authorization
- Hazardous materials unless certified and pre-approved
- Any goods prohibited by Jamaican law, US regulations, or destination-country laws
We reserve the right to inspect, refuse, return, or dispose of any shipment that violates these restrictions, and to report such shipments to the appropriate authorities.
11. Liability and Limitations
To the maximum extent permitted by applicable law:
- Loss or Damage: Our liability for lost or damaged shipments is limited to the declared value of the goods or the applicable service fee paid, whichever is lower, unless additional insurance was purchased.
- Delays: We are not liable for delays caused by customs authorities, weather, third-party carriers, civil unrest, or other events beyond our reasonable control.
- Indirect Damages: We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
- Service Interruptions: We do not guarantee uninterrupted or error-free access to our digital platforms.
- Notifications: We do not guarantee the delivery or timeliness of any email or WhatsApp notification, as set out in Section 8.
- Estimates: The rate estimator is indicative only and does not bind us to a price.
Nothing in these Terms excludes liability for death, personal injury, fraud, or any other liability that cannot be excluded under Jamaican law.
12. Intellectual Property
All content on our Services — including logos, trademarks, software, text, graphics, and design — is owned by or licensed to the Companies and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent.
Any feedback, suggestions, or ideas you submit to us may be used by the Companies without obligation or compensation to you.
13. Third-Party Services
Our Services rely on third parties, and parts of what you see come from them. WhatsApp notifications are carried by Meta Platforms. This website embeds a Google map on the branch locator, uses a third-party address-lookup service for address suggestions, and loads Google Analytics when analytics is enabled. Our platform is hosted by third-party cloud providers, and payment, carrier, and customs-brokerage partners handle their own parts of a shipment. The current list of the providers we use is in our Privacy Policy.
The customer portal relies on fewer of them: it uses Cloudflare Turnstile to check that a sign-in, sign-up, or password-reset attempt comes from a person, and its sign-up page loads country-flag images from a public image host. It carries no analytics, no advertising technology, and no embedded map.
We are not responsible for the practices, content, availability, or reliability of such third parties. Use of third-party services is subject to their own terms and privacy policies, and we encourage you to review these before engaging with them.
14. Termination and Suspension
We may suspend or terminate your access to the Services at any time and without prior notice if:
- You breach any provision of these Terms;
- We reasonably suspect fraudulent, unlawful, or abusive behavior;
- We are required to do so by law or regulatory order.
You may close your account at any time by contacting us (see Section 17). Upon termination, outstanding obligations — including payment of fees or outstanding shipments — remain enforceable. Unused store credit, rewards points, and referral credit are settled in line with Section 7 and our Refund Policy.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Jamaica.
Any dispute arising from or relating to these Terms or our Services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Kingston, Jamaica, in accordance with the Arbitration Act (Jamaica).
Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Companies, their Affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from:
- Your use of the Services;
- Your violation of these Terms;
- Any shipment you arrange that causes harm or violates applicable law;
- Any declaration or customs document you submit that proves to be false or incomplete;
- Your infringement of any third-party rights.

We may revise these Terms periodically to reflect operational, legal, or regulatory updates. The latest version will always appear on our websites. If we make material changes, we will notify users by email or in-app notice before the new terms take effect. Continued use of our Services after such notice constitutes acceptance of the revised Terms.
